Taber, Melvin.
According to a statement (once at URL www.cochlear.org/sys-tmpl/individuals1/) of the ORM website: "This police chief for Sweet Springs, MO [Melvin Taber] refused to allow a man with cerebral palsy to drive a golf cart on city streets, even though he was not violating any state or local law. Such inexplicable action resulted in an ADA lawsuit and numerous citizen protests." This website does not know if that ORM statement is true. Incidentally, ORM refers to Taber's alleged conduct as "inexplicable". We don't find that conduct inexplicable. In much of Missouri, government officials (for example: prosecutors, sheriffs, police chiefs, and judges) blithely disregard the law, instead doing what seems fair and feels right. The euphemistic description of such officials and their orders is "fact-oriented" and "fact-based". Also incidentally, such behavior is not necessarily rural. For example, New York city's police chief Raymond W. Kelly is as fact-based as Sweet Springs's allegedly was in the golf cart matter.
An anecdote about Missouri follows, reported from memory of events decades ago. This report is sincere but may have mistakes.
A person, Person1, was handcuffed by police in a de facto arrest and brought to a jail. He was told the amount of bail, which he immediately paid in full. Nevertheless, he was held in jail.
An officer informally told Person1 that there was a second charge, distinct from the bail charge, and that he was being held on the second charge. A different officer in a diferent conversation shook his dead in disapproval of the irregular, illegal manner in which Person1 was treated regarding his being jailed on the non-bail charge. The officer explained part of the illegality to Person1. For example, there was no arrest warrant.
Person1 was not given any papers of any kind about the second charge. There was no opportunity to pay bail on the second charge. There was no court hearing of any kind on either charge. Days passed. Weeks passed. Still there was no hearing for the jailed prisoner.
Recall that there were two charges. Regarding one charge, Person1 had a bail receipt. In the second charge, Person1 had nothing in writing, no papers of any kind.
Person1 eventually wrote to a few, powerful, crime-fighting agencies complaining about the charge on which he was held in jail, the non-bail charge. He complained that he was being held in jail for a long time with no hearing and without being given any papers. He wanted to be free and he wanted his jailers punished. More than a week after he mailed his requests to the crime-fighting agencies, the jail gave him a copy of an arrest warrant and perhpas some other papers. Much later, there was a Greene County hearing or two in that case. Person1 lost without receiving any explanation from the court. In many places, a judge has no legal duty to explain his decision. However, if a judge wants feedback or wants to be polite, he explains his decision at least briefly.
Person1 wrote letters to try to get his bail money refunded to him. Person1 wrote to the county government to get forms and rules governing suing the county for not giving him a hearing on the bail charge. Then, he mailed claim papers to the county government. Soon after he mailed the claim papers, becasue he mailed them, there was a court hearing regardin the bail charge. In the hearing, he told the judge that he, Person1, requested the case be dismissed because too much time had passed without a hearing. Person1 said that a vital deadline had passed. The case was not dismissed. Person1 said that he wanted a jury trial. The court said that maybe there would be a jury trial. The court hearing ended. After that hearing, there was never a trial or any other hearing in that case, as far as Person1 knows. Eventually, the case was somehow dismissed in Person1's absence and without his knowledge at that time. Later, Person1 investigated and, as result, found out about the dismissal. Bail was not returned to Person1 although it would have been easy to do so. Person1's bail money was paid to the Missouri state government. Much later, Person1 discovered what had happened to his bail money and got it from the state government.
Person1 wrote to the state government to get a copy of his Misouri arrest record. The state government wrote back that he had no arrest record. The state government had no record of his having been arrested. Maybe there was an arrest but it was not reported to the state government. Was Person1 legally held in jail without an arrest?
Under certain circumstances, it may be a crime to hold someone in jail without an arrest, or to hold him after the deadlien for a hearing (often called an arraignment) if there was no hearing. Greene County's criminal-jailers, if any there be, should be legally arrested and prosecuted. Prisoners should not be held in a jail if the staff has illegally held prisoners particularly if the illegality has been egregious or criminal. For that and other reasons, there should be an impartial investigation to find out how many times prisoners were held illegally in Greene County jail.
Under certain circumstances, it may be a crime to file criminal charges against someone but refuse afterwards to prosecute the case or seek its dismissal (particularly when the defendant wrote that he was harmed by the pendency of the case). Greene Copunty's criminal-prosecutors ("criminal-prosecutors" in the sense of prosecutors who do crimes in the way they handle a criminal case), if any there be, shoule legally arrested and prosecuted. There should be an impartial investigation to find out how many times, in Greene County, prosecutors have neither requested dismissal of a criminal case nor prosecuted it.
When Person1 was taken to court, he was told about the trip to court shortly before the trip to court began, perhaps half an hour or so before. He was not told which court, which case, or for what kind of hearing. He correctly guessed that it was a case in which he was a defendant (not a case in which he might be a witness but not a defendant, for example). He could not prepare for the hearing because he did not know which case (the bail case or the other case) or the purpose of the hearing. From the prosecutor's snide remark in the courtroom a few minutes before the judge began speaking, Person1 inferred the purpose of the hearing. It may have been illegal, perhaps a violation of judicial or professional ethics, not to notify Person1 of the hearing until literally a few minutes before it began. In some places, all parties must be notified several days before a hearing. If the court or prosecutor had a duty to notify Person1 of the hearing in advance, that duty may have been breached. Person1 had the impression that it was customary in Greene County not to give IPPPs (in properia persona prisoners, prisoners who repersent themselves) more than trivial, advance notice of trials or other hearings. A prisoner-defendant has a right to public hearings and to have his witnnesses testify for him. He is denied those rights when he has almost no advance notice of his hearings because he is unable to tell the public (for example, people who want to come to court to watch his hearing or to testify for him). In court, Person1 would have spoken even better had he been told about the hearing even one day in advance. Person1 had spent much time in the jail's law library studying. He would have used a day's advance notice of the hearing to refersh his memory, review his notes, and prepare a statement for the hearing.
The judge seemed not to have done any research to prepare for the hearing.
Person1 never got any paperwork in opposition to his paperwork. For example, Person1 never got any document prepared by a prosecutor in which there was oppostion to any any argument or request of Person1. In America outside of Missouri, courts generally think of themselves as adversay venues. If one party submits a document containg a request, and if there is no opposing document, many courts are inclined to grant the request. Person1 never saw any opposition paperwork or heard any prosecutor (or witness) speak against Person1 in court, yet no judge granted Person1 any of his requests. The prosecutors' lack of advocacy (with the exception of a snidely spoken remark made out of the judge's hearing) was not harmful to the prosecution because the judges did everything that a judge would have guessed police wanted. The judges did not seem to be impartial arbiters who do not care which side wins. The judges seemed to be trying to back up the police.
The account of events above may not be perfectly accurate.
In conclusion, it is not inexplicable that the law is broken by executives of a crime-fighting agency in Missouri.
