      In our small, unscientifically constructed sample of officers, some of the officers are physicians. A high percentage of the physicians in our sample:

      1. lost medical malpractice litigation or were professionally punished by the state government of California (much higher than the percentage of all California physicians who were punished, we guess); for example, Larry H Dizmang, Harvey Ming Huang, and Garen T. Vong.

      2. attended medical school outside America (for example: in India, Italy, the Philippines, and Uganda).

      Many DCR physicians were described (before, during, or after working for DCR) as specializing in areas of medicine for which we guess DCR has a a limited need; for example: family practice, space medicine, and child psychiatry. Few DCR physicians were described as general practitioners.

    3. Welcome to San Quentin.

      22 December 2011

      A county jail prisoner once had a prisoner commissary account in that jail. He used his account to buy sneakers from his jail's commissary. The prisoner, account, commissary, and sneakers were all in the county jail. In the middle of the night, the prisoner was woken and taken to a small room without a bed. He was given a blanked. He slept on the floor, sometimes sleeping on the blanket rather than directly on the hard floor, sometimes sleeping directly on the hard floor so that he could get a bit of warmth by having the blanket over him. It is illegal in that jail for the staff to make prisoners sleep on the floor. The sleepy prisoner slept on the floor because there was no bed. The prisoner was woken early in the morning so that he could be sent to state prison. He stopped lying on the floor and instead stood. He was given at least one receipt to sign and told to sign. He signed. The jail staff examined the prisoner's property to be sure that it did not include any property not owned by that prisoner. The county jail staff transferred him and that part of his property which the staff did not steal (for example, his sneakers were transferred, not stolen from him) to CDCR's ICR (Inmate Reception Center) at San Quentin State Prison. When he arrived at San Quentin, he was sleepy, hungry, and nauseated. He was on line with other new prisoners entering that prison that day. The prisoner neither wore nor possessed his sneakers while he was on that line.

      A white, male, bored-looking, CDCR CO who had obtained the sneakers dangled them by their laces in front of the prisoner and asked him an obvious;y incomprehensible question, "County or private?". That was the entire question. The prisoner answered "County." That was the last time the prisoner ever saw those sneakers. CDCR wrongly deprived him of his sneakers, not even giving him a receipt for them.

      Later that day, the new prisoner was brought to his cell at San Quentin, a two-person cell with a toilet and a sink but no toilet paper, soap, or towel. The prisoner eventually, luckily happened upon someone who could obtain things. As a result of that person's intervention, the prisoner soon had toilet paper, soap, and a towel. Toilet paper, soap, and a towel should have been in the cell when he got there.

    4. Discussion: racial and similar problems

      1. Some staff and prisoners in some DCR prisons engage in racial and similar kinds of mistreatment of prisoners.
      2. When prisoners mistreat, it's often hate-motivated mistreatment by prisoners who well understand what they are doing.
      3. The staff maliciously denies some openly gay prisoners benefits that other prisoners get.
      4. Some white C.O.s dislike blacks or like whites much more than blacks. Some white C.O.s dislike to even see a black. We suppose that this is legal. Some, black prisoners are infuriated when they discover a C.O.'s anti-black attitudes. They discover by paying attention to what C.O.s say when chatting with prisoners. For C.O.s who chat with prisoners in complete sincerity, it may be impossible to avoid occasionally revealing racial likes and dislikes.
      5. A female employee in a prison was, for some prisoners assigned to her, sort of like a high school guidance counselor is for students. She talked with a redheaded, male prisoner who had been violent to his wife. According to the prisoner, the employee told him, more of less, that redheads are more impulsive and violent than other people, and that he had "nothing coming". The prisoner thought that she was knowingly, illegally punishing him for what he had done to his wife.
      6. A few, DCR C.O.s occasionally, unintentionally are rude as the result of assuming that every prisoner they talk to is Christian.

    5. DCR (CDC) discussion and opinion

      Federal court monitor John Hagar, whom U.S. District Judge Thelton Henderson supervises, wrote about lies, perjury, brutality, and refusal to investigate at the CDC. Although the report suggests that top officials could be prosecuted, this did not happen, as we predicted (on this page on 5 April 2004) it would not.. Many prosecutors in California run for office bragging about their having been endorsed by law enforcement officer unions and correctional officer unions. Elected prosecutors appreciate those endorsements and related contributions. Most prosecutors in California loath prosecuting correctional officers as much as CDC executives loath investigating them, and for essentially the same reasons. Furthermore, the people described by Hagar have enthusiastic supporters throughout the world. How can we substantially reduce the grim problems described by Hagar? In our opinion, if those problems can be substantially reduced, maybe a way to do so is by legally weakening law enforcement officers' unions and especially correctional officers' unions, and by electing politicians not endorsed by those unions. Read carefully from a wide variety of sources before forming your own opinion.

      Federal district judge Thelton Henderson wrote, in a letter released about 20 July 2004, that the recent agreement between the CCPOA union and the Arnold Schwarzenegger administration was "business as usual" in the state's scandal-plagued prison system, that the agreement gives the union more control than management has inside prison walls, and that the judge was considering taking over the California state Department of Corrections. Because California's federal trial courts also engage in business as usual, the judge did not take over the California state Department of Corrections except for a takeover in 2006 of most of the medical care provided to adult prisoners. As part of the medical takeover, there is a report about medical care provided to prisoners in 2006 in the California state prison system: (at former URL www.cprinc.org/docs/court/Receiver1stBiMoR070506.pdf) Receiver's First Bi-Monthly Report, 5 July 2006, in the United States District Court for the Northern District of California case C01-1351-TEH, a case in which Arnold Schwarzenegger and others are defendants. The report covers waste of money by the state prison system, inadequate punishment of prison medical staff, and terrible medical care provided to prisoners.       Consider a hypothetical prisoner of CDCR, perhaps a parolee who physically is outside a California prison but legally is considered a prisoner of CDCR because he is on parole. He leaves California without his parole officer's permission and is arrested in Vermont because he left California. CDCR could have its parole officers fly to Vermont, take physical custody of him, and bring him back to California. Instead, CDCR hires a corporation which is a private, prisoner-transportation business to physically take him from Vermont to a CDCR prison in California. We are under the impression, perhaps wrongly, that California buys prisoner-transportation service from one or more corporations. The corporation drives the chained, shackled, handcuffed prisoner in a van from Vermont to California. Legally, the corporation is a person which can be arrested and prosecuted, and the property of which can be confiscated if used to do a crime. If a corporation or its C.O.s does a crime to a CDCR prisoner while transporting him outside California, who investigates and arrests? Would criminal investigation and arrest be done by internal affairs officers of CDCR? Who inspects to find out of the corporation provides, for example, proper food, sleeping facilities, ventilation, and medical care to the CDCR prisoner outside California; for example, while he's in a moving van for prolonged periods? If the treatment of DCR prisoners in a moving van outside California is so cruel as to be a crime, which agency's detectives investigate and arrest?

      Reckless behavior sometimes is criminal. For example, people sometimes are prosecuted for firing a gun or driving a car recklessly. It is possible to practice medicine (for example, in a DCR prison) in a criminally reckless manner (which reckless might have, as part of its evidence, lack of proper records and lack of appropriate, diagnostic tests). As far as we know, there isn't a rule that a physician's treatment of his patient never is criminally reckless. Some physicians are negligent and some ore reckless. If a misdemeanor (perhaps a physician's misdemeanor recklessness) causes death, the one who did the misdemeanor is guilty of the felony of manslaughter, which felony often is called misdemeanor manslaughter. A driver can get a ticket for reckless driving even if no one is harmed but a physician won't get a ticket for recklessly practicing medicine if no one is harmed. DCR's Internal Affairs officers never give tickets for reckless practice of medicine. There is something unfair about the government criminally punishing commoners but not physicians for recklessness.

    7. 2004 December 27, discussion of some 2003-2004 expenditures of CCPOA IC (CALIFORNIA CORRECTIONAL PEACE OFFICERS ASSOCIATION [CCPOA] ISSUES COMMITTEE [A NON-PROP 34 COMMITTEE]).

      An interesting feature of CCPOA IC expenditures in 2003-2004 (shown in the web page linked to just above) is that CCPOA IC paid exactly the same amount of money every month to some recipients, for many months. For example Sacramento attorney at law Wayne Lee Ordos (a specialist in political law) got exactly ten thousand dollars monthly for many months. When a lawyer is paid a fee for work he does, the fee usually varies from month to month. If the lawyer bills to be reimbursed for out-of-pocket expenses, those expenses usually vary from month to month.

      Rent usually is the same from month to month. If the client or lawyer think that the client is renting the lawyer or his name, then a fixed monthly fee may result. For example: if, when the client has a legal problem, what's important to the client is that a phone call or letter go from that lawyer to the source of the problem (not the amount of time that the lawyer or his associates worked), then the client is essentially renting the lawyer, not buying his work.
